Terms of Service
Welcome to HomeInventory, a service provided by Pedersen Software LLC ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website located at spchomeinventory.com and our related services, including our asset tracking and vault applications (collectively, the "Service").
By registering for an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Description of Service
HomeInventory provides a secure, cloud-based database for cataloging personal assets, generating valuation reports, and storing related media (such as photos and receipts). We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
2. User Accounts & Security
- Account Creation: You must provide accurate, current, and complete information during registration.
- Security: You are responsible for safeguarding your master password and any account credentials. We utilize cryptographic standards to secure your data, but we cannot be held liable for unauthorized access resulting from your failure to secure your credentials.
- Communication: By creating an account, you agree to receive essential service-related emails (e.g., password resets, billing notices).
3. Subscriptions, Free Tier, and Billing
- Free Tier: We offer a free account tier that allows you to store a maximum of ten (10) items in your vault indefinitely. Upon upgrading to a "Vault Pro" subscription, this limit is lifted, unlocking infinite vault space.
- Billing: Subscriptions are billed automatically on a recurring monthly basis via our third-party payment processor (Stripe). By providing payment information, you authorize us to charge the applicable fees.
- Cancellations: You may cancel your subscription at any time through your Account Dashboard. Cancellations take effect at the end of the current billing period. No prorated refunds are provided for partial months.
- Downgrades: If your subscription ends or fails to renew, your account will be downgraded to the free tier. You will not lose your data, but you will be unable to add new items if your vault already contains ten (10) or more records until payment is resolved.
4. User Data and Content Ownership
You retain full ownership of all data, text, images, and documents you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display your data strictly for the purpose of providing the Service to you.
5. Prohibited Conduct
You agree not to:
- Upload illegal, harmful, or explicitly offensive content.
- Attempt to bypass our security measures, CSRF shielding, or access data belonging to other users.
- Use the Service for any unlawful purpose or to facilitate fraud.
- Upload viruses, malware, or malicious code.
We reserve the right to immediately terminate or "purge" accounts that violate these restrictions.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEDERSEN SOFTWARE LLC OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE. OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Data Portability and Deletion
You may export your data (via CSV) or delete specific items at any time using the tools provided in your dashboard. If you wish to permanently delete your entire account and all associated data, you must contact support or use the provided account deletion tools.
9. Changes to Terms
We may modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date and providing an alert within the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Salt Lake County, Utah, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
